BSR PRO Terms of Service

By accessing or using BSR PRO™ (the "Service"), provided by BSR Constructions LLC ("BSR," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Account & Access

• You must use credentials authorized by BSR to access the Service.
• You are responsible for keeping your username and password confidential.
• Sharing credentials with anyone outside your authorized team is prohibited.
• We reserve the right to revoke access at any time for breach of these Terms or non-payment.

2. Acceptable Use

You may use the Service only for legitimate estimating and pricing purposes. You may NOT:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying logic of the Service.
• Bulk scrape, harvest, or systematically extract data, content, or output from the Service.
• Use the Service, its output, or its structure to build, train, or develop a competing product or service.
• Use output to train artificial intelligence or machine learning models without express written permission from BSR.
• Resell, redistribute, sublicense, lease, rent, or otherwise transfer access to the Service.
• Attempt to circumvent authentication, access controls, or any technical limitations.
• Misrepresent yourself, your affiliation with BSR, or use the BSR PRO™ mark without authorization.

3. Intellectual Property

• All code, design, layouts, calculations, copy, branding, and content within the Service are the exclusive property of BSR Constructions LLC.
• BSR PRO™ is a trademark of BSR Constructions LLC. All rights reserved.
• You receive a limited, non-exclusive, non-transferable, revocable license to use the Service while subscribed.
• You do not acquire ownership rights of any kind through use of the Service.

4. Pricing & Estimates

• BSR PRO is a calculator tool. Default pricing, rates, and tax values are guidelines based on market data — they are not professional estimates.
• All bids, estimates, and pricing decisions generated through the Service are your sole responsibility. You accept all risk for accuracy, fitness, and completeness.
• BSR is not liable for any job bid, contracted, or performed based on calculations produced by the Service.
• Sales tax rates are approximations and should be independently verified with current state and local tax authorities before final pricing.

5. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. BSR makes no guarantees about uptime, availability, or absence of errors. Use at your own risk.

6. Limitation of Liability

To the maximum extent permitted by applicable law, BSR's total cumulative liability to you for any and all claims arising out of or related to the Service shall not exceed the total fees you paid BSR in the twelve (12) months preceding the claim. BSR is not liable for lost profits, lost revenue, lost data, business interruption, or any indirect, incidental, consequential, special, exemplary, or punitive damages, even if BSR has been advised of the possibility of such damages.

7. Termination

• We may terminate or suspend your access immediately, without prior notice, for breach of these Terms.
• You may discontinue use of the Service at any time.
• Sections 3 (Intellectual Property), 5 (Warranty Disclaimer), 6 (Limitation of Liability), 8 (Governing Law), and any other provision that by its nature should survive termination, will survive.

8. Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction therein.

9. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
